(PLTM) - Tifern Henley, 35, a BVIslander, pleaded not guilty to five charges stemming from an incident where he allegedly assaulted his girlfriend and attempted to kidnap her and her kids.

Henley made an appearance at the Magistrate’s Court earlier today, May 15, to respond to charges of assault, occasioning actual bodily harm, reckless and negligent act, taking conveyance and two counts of criminal damage.

According to the particulars of the matter, on May 7, in Tower’s Estate, West End, Henley entered the home where his two toddlers and their mother reside, sometime around 1:00 am.

The court heard that around this time, the female woke up, left her bedroom and journeyed to the kitchen, which is when she was attacked by the accused.

During the assault, Henley allegedly punched her multiple times in her face and the back of the neck. He then dragged her to the other side of the room, all while she tussled and screamed for help.

It was also noted that Henley forced her and the kids into her vehicle and proceeded to drive off, but the mother made her escape after Henley accidentally hit a gate while reversing.

About 150 meters away from the residence, Henley then allegedly hit another vehicle and fled the scene right after. The court heard that he left the children in the vehicle.

In the court’s deliberation on whether or not to offer bail to the accused, Magistrate Ayanna Baptiste Dabreo took into consideration that a protection order was filed against the accused by the female.

Prior to her decision, Magistrate Baptiste-Dabreo stated that according to the allegations, “It shows purpose of his determination of whatever he wanted to do. Any person who is determined to do what they want to do, a piece of paper won’t stop them.”

She further noted that based on the circumstances of the matter, it is not the worst of the bunch to deny bail.

He was offered bail in the sum of $50,000 with signed surety. He is ordered to keep away from the virtual complainant and the children in the matter, as well as to attend the Partnership For Peace programme.

He will make another appearance on July 14.

Henley is represented by Mr. Stephen Daniels.
