Collin Green, 36, a Jamaican native was this morning, July 12, sentenced to seven years in prison for having sex with a minor in August of last year.
Unlawful sexual intercourse with a girl under the age of 16 years old carries a maximum of seven years, while rape carries a maximum of life imprisonment.
Last week, Green pleaded not guilty to rape and guilty to having sexual intercourse with a girl under the age of 16. The crown accepted the guilty plea.
Justice Albert Redhead before handing down his sentence, noted that the crown was over generous by accepting a guilty plea for the lesser charge. A visibly upset Redhead said it is the fundamental right by every woman not to be abused by men and men in society need to be aware of that.
"It annoys me that my hands are tied and I cannot go beyond seven years...It hurts me that my hands are tied...Here he [Green] is; he gets away...But no matter what Mr. Daniels [lawyer] come and say or plea, he will get the maximum," the Judge stated.
The Judge told Green, "You pounced on her like a wild animal; even wild animals do not do that..."
The Judge further stated, "Men must understand that they must not molest women. Leave young girls alone."
During his plea in mitigation, lawyer Stephen Daniels said Green has been living in the Territory for the past four years and is a construction worker. Green has three children in Jamaica, including a daughter.
Green has previous offences of being armed with an offensive weapon and disorderly conduct.
Daniels said they decided to go with the guilty plea because the victim did not want to face Green.
Meanwhile, Prosecutor Leslie Ann Faulkner said some of the aggravating factors included the prevalence of these type of offences in the Territory; breach of trust; he has previous convictions; she was in a vulnerable position; the age difference - the victim was 15 years old and Green was 36 years old at the time; and from the night before the incident, he exercised some level of preying.
The victim also suffered psychologically and she was fearful of having to face Green in court.
Faulkner said it has been a traumatic experience for the teenager.
It was the crown's case that Green took the victim out of her bedroom on the early morning of August 7, 2012 while she was asleep. After taking her, she was awaken to him over her.
Green then had sex with her despite her pleas for him to stop.
Following the incident, the minor called her friend and mother and informed them of the incident.
Faulkner said prior to August 7, the minor never had sex and noted that this was confirmed following a medical examination.
