Baughers Bay Man Allegedly Assaults Lover Over Family Dispute

(PLTM) - Earl Hazel Jr. of Baughers Bay was granted $30,000 bail with one surety after he allegedly assaulted his Trinidadian lover following a family dispute.

The 24-year-old man, with one daughter, appeared before the court on Thursday, October 21, where five complaints were only read for his information.

He was charged with Assault Causing Actual Bodily Harm, Disorderly Conduct in a Police Station, Criminal Trespass and two counts of Criminal Damage.

Crown Counsel Lyn Dailey informed the court that the defendant is a BVIslander residing in Baugher’s Bay and the complainant is a Trinidadian residing at Hope Hill.

On Sunday 17 October 2021, at 8.30 pm, the complainant and the defendant were at the complainant's residence in Hope Hill when they left in her motor jeep to go the defendant’s mother’s dwelling home in Baugher’s Bay.

Upon arrival, she assisted the defendant’s mother with some travel documents, and as a result of this, the defendant and his mother had a heated verbal exchange which left the defendant shouting at the mother, and the complainant intervened to diffuse the situation.

She then decided to depart from the house and headed for her jeep, and locked the doors. While there the defendant approached the vehicle and knocked on the hood of the jeep in question while asking the her to refrain from leaving.

However, she continued to drive, and the defendant shouted for his mother to assist; and the defendant’s mother approached the complainant's jeep and knocked on the window, and the complainant responded by sliding down the said window’s glass to speak to her.

At that point, the defendant opened the jeep’s door and hurled the complainant out of the jeep by her neck and started hitting her in her head and about her body.

The defendant’s mother attempted to intervene, but the defendant continued beating the complainant. The defendant then went inside her jeep and drove for about 10 feet away from the Speed Clean Laundry, and parked the vehicle.

At that time, the complainant walked away to evade the defendant but he attacked her again and dragged her by her neck on the concrete pavement in the direction of the parked vehicle.

The ordeal was interrupted by a neighbour who stopped the defendant from continuing the attack.

The Police were called in to intervene at about 9.09 pm, and after speaking to the complainant, the Police invited her to seek medical attention, but she refused.

Meanwhile, the defendant was met at the scene, and he was informed of the report and cautioned, and he replied: “we had a little argument.”

He was later taken to the Road Town Police Station, and he declined to have an audio visual interview.

The following day, October 18, the defendant was granted bail in the sum of $5,000 to appear before the court.

The court heard that on the day he was granted bail, the defendant appeared at the home of the complainant at about 8 am.

She indicated to Police that the defendant called her for a ride from the police station, and she refused. The defendant also requested her presence at his residence, and she also refused.

Later that morning, at about 9.30 am he visited the complainant's residence in Hope Hill and demanded for her to open the door. The court heard that she informed him that she was no longer interested in talking to him, and he replied that he hid money in her apartment and wanted to enter.

The complainant then indicated to him that he should return with the Police, and despite her words, the defendant kept pounding on the door. She then informed him that she would call the Police, and he left shortly after.

At about 10.30 am, the complainant looked outside to ensure that he had left, and she left with a coworker. At about 5 pm the defendant returned home and kept pounding on her front door.

He went to the bathroom window calling out to her to open the door and he proceeded to break the bathroom window, he then punched another glass in the kitchen window, placed his hands through the mesh and pulled down the curtains and went back to the front door and tried to unlock the door.

He managed to open the top lock, and he eventually entered the house and grabbed her clothing, tearing it and allegedly threatened to kill her and slice her up.

The complainant was terrified, and she tried using her phone to call the Police, but the defendant grabbed her phone and threw it to the ground and stomped on it, destroying it.

The Police were eventually called to render assistance.

Bail

Despite the Crown objecting to bail on the grounds that he breached his bail conditions, Hazel Jr.’s lawyer Mr. Michael Maduro made a successful pitch, stating that the offences were bailable and there was no evidence that he would abscond.

Magistrate Khadeen Palmer subsequently granted the defendant $30,000 bail with one surety.

He has to report to the Road Town Police Station twice a week and was warned to not interfere with the complainant.

The matter was adjourned to November 24.
